What are you agreeing to?

By accessing or using Viewfy ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. You must be at least 18 years old to use the Service.

What does Viewfy do?

Viewfy is a marketing campaign management platform that helps you create, manage, and analyze advertising campaigns across third-party platforms including Meta (Facebook/Instagram). The Service uses artificial intelligence to generate ad creatives including images, videos, voiceovers, and ad copy on your behalf.

How does the managed advertising service work?

Viewfy offers a managed advertising mode where we run ad campaigns on your behalf using our own Meta ad account. By using the managed service, you agree to the following:

  • You deposit funds into your Viewfy account balance to fund campaigns
  • When you publish a campaign, the full budget is reserved from your balance
  • Viewfy retains a service fee (margin) from your campaign budget; the remainder is spent on Meta advertising
  • Ad spend is deducted as Meta reports actual delivery costs
  • Any unspent budget is returned to your account balance when a campaign ends
  • We create and manage a Facebook Page on your behalf to serve as the identity for your ads
  • Campaign performance, ad delivery, and results are subject to Meta's platform policies and are not guaranteed by Viewfy

How do payments and refunds work?

  • Deposits are processed via Stripe and are non-refundable once spent on active campaigns
  • Unused account balance may be refunded upon request, subject to review
  • Viewfy's service fee on managed campaigns is non-refundable
  • You are responsible for ensuring sufficient balance before publishing campaigns

What are you responsible for on your account?

  • You must provide accurate account and business information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access
  • You are responsible for all activities under your account
  • You must comply with all applicable advertising laws and regulations in your jurisdiction

What are you not allowed to do?

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Create misleading, fraudulent, or deceptive advertising content
  • Advertise prohibited products or services (as defined by Meta Advertising Standards)
  • Violate the terms of connected third-party platforms including Meta Platform Terms
  • Misuse lead data collected through campaigns (you must handle leads in compliance with applicable privacy laws and Meta's Lead Ads Terms)
  • Attempt to access other users' accounts or data
  • Interfere with or disrupt the Service

Who is responsible for AI-generated content?

The Service uses artificial intelligence to draft blog posts, images, social posts, replies to community threads, outreach emails and ad creatives on your behalf. By using these features, you acknowledge that:

  • AI-generated content may not always be accurate, appropriate, or suitable for your use case
  • You decide whether and where content is published. With auto-publish on, you instruct Viewfy to publish without your review; with it off, nothing publishes until you approve it
  • When you approve a post you confirm that you read it and checked its facts. Viewfy records who approved it and when, and the published page names you as the person who reviewed it
  • Posts published without a person's review are labelled as generated with AI, and images carry machine-readable provenance marks (C2PA Content Credentials and IPTC metadata). You must not remove, hide or alter these labels or marks
  • Under the EU AI Act, Viewfy is the provider of the generating system and you are the deployer of its output on your channels. Viewfy marks the output; you are responsible for how and where it is used, for the visible labels on channels you control, and for naming the person or company that holds editorial responsibility for your blog
  • You are solely responsible for ensuring published content complies with applicable laws and platform policies
  • Viewfy does not guarantee that AI-generated content will achieve specific performance results

Which third-party platform terms also apply?

The Service integrates with third-party advertising platforms, primarily Meta (Facebook/Instagram). Your use of these platforms through our Service is subject to their respective terms and policies, including:

We are not responsible for the availability, accuracy, or policies of third-party platforms. Meta may reject, pause, or remove ads for policy violations, and Viewfy is not liable for such actions.

Who owns the content you create?

You retain ownership of content you create and upload. By using the Service, you grant us a non-exclusive, worldwide license to use, store, and process your content solely to provide the Service, including submitting it to Meta for ad delivery. AI-generated content created through the Service is licensed to you for use in your advertising campaigns. The Viewfy name, logo, and software are our property.

What do you indemnify Viewfy against?

You agree to indemnify and hold harmless Viewfy, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your advertising content or campaigns, (d) your misuse of lead data, or (e) your violation of any third-party rights or platform policies.

What warranties does Viewfy give?

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation, specific advertising results, approval of ads by third-party platforms, or compatibility with all third-party platforms. AI-generated content is provided without warranty of accuracy or fitness for purpose.

How is Viewfy's liability limited?

To the maximum extent permitted by law, Viewfy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service. Our total liability shall not exceed the amount you have paid to Viewfy in the 12 months preceding the claim.

How can this agreement be terminated?

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason with reasonable notice. You may terminate your account at any time by contacting us.

Upon termination: (a) your right to use the Service ceases immediately, (b) active campaigns will be paused, (c) remaining account balance (less any pending ad spend) will be refunded within 30 days, and (d) your data will be handled per our Privacy Policy.

Which law governs these terms?

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware, and you consent to personal jurisdiction in such courts.

How will you be told about changes to these terms?

We may modify these terms at any time. We will notify you of material changes via email or through the Service at least 14 days before they take effect. Continued use after changes constitutes acceptance.
